By accessing or using our website, submitting any form, registering for any program, making any payment, paying any invoice, clicking any payment link, attending training, participating in any class, camp, clinic, tournament-related activity, private lesson, group session, event, evaluation, or academy activity, you agree to comply with and be bound by these Terms of Service.
If you are registering, paying, or authorizing participation for a minor, you confirm that you are the parent, legal guardian, or authorized responsible party and that you have legal authority to accept these Terms on behalf of the minor participant.
Payment of any invoice, deposit, balance, program fee, uniform fee, tournament preparation fee, camp fee, clinic fee, private lesson fee, or any academy-related charge constitutes acceptance of these Terms of Service.
If you do not agree with these Terms of Service, you should not use our website, submit our forms, register for our programs, make payment, pay any invoice, or participate in Zenniq Academy services.
1Service Description
Zenniq Academy is a tennis training and player development academy offering technical, tactical, physical, mental, and competitive development programs for children, teenagers, and adults.
Our services may include group training, private coaching, player development programs, tournament preparation, camps, clinics, evaluations, physical conditioning, tennis-related activities, and other academy programs.
Zenniq Academy provides coaching, structure, development guidance, and training opportunities. However, Zenniq Academy does not guarantee any specific athletic result, tournament victory, ranking, scholarship, UTR improvement, USTA ranking improvement, college placement, professional opportunity, team selection, or competitive achievement.
Player progress depends on many factors, including but not limited to consistency, attendance, discipline, effort, attitude, physical condition, maturity, tournament participation, family support, training frequency, and long-term commitment.
2Acceptance of Terms
By registering for Zenniq Academy programs, submitting a form, making payment, paying an invoice, clicking a payment link, or allowing a player to participate, the player, parent, legal guardian, or responsible party confirms that they have read, understood, and accepted these Terms of Service.
These Terms include, but are not limited to, payment policies, no-refund policies, attendance policies, no-rollover policies, make-up class policies, weather policies, uniform requirements, tournament conduct, parent conduct, player conduct, non-interference policies, media/photo/video authorization, communication policies, injury and liability terms, and disciplinary policies.
Zenniq Academy may require electronic acceptance, written acceptance, checkbox confirmation, payment confirmation, invoice payment, or continued participation as evidence of agreement to these Terms.
Failure to read the Terms of Service does not release the player, parent, legal guardian, or responsible party from complying with academy policies once registration has been submitted, payment has been made, an invoice has been paid, or the player has participated in any Zenniq Academy activity.
3Payment as Acceptance of Terms
By making any payment to Zenniq Academy, including but not limited to monthly payments, program fees, camp fees, clinic fees, private lesson fees, evaluation fees, tournament preparation fees, uniform fees, deposits, partial payments, invoice payments, payment links, credit card payments, debit card payments, Zelle payments, bank transfers, cash payments, or any other payment method, the player, parent, legal guardian, or responsible party acknowledges and agrees that they have received access to, had the opportunity to review, and accepted Zenniq Academy’s Terms of Service.
Payment of any invoice, payment request, deposit, balance, or academy fee constitutes acceptance of all academy policies, including but not limited to payment terms, no-refund policy, attendance policy, no-rollover policy, make-up class policy, weather policy, uniform policy, player conduct, parent conduct, tournament conduct, non-interference policy, media/photo/video release, liability terms, and disciplinary policies.
The player, parent, legal guardian, or responsible party understands that failure to read the Terms of Service does not release them from complying with academy policies once payment has been made, registration has been submitted, or the player has participated in any Zenniq Academy activity.
Continued participation in Zenniq Academy programs after receiving an invoice, making a payment, attending class, or using academy services also confirms acceptance of these Terms of Service.
If the player, parent, legal guardian, or responsible party does not agree with these Terms of Service, they should not make payment, complete registration, or allow the player to participate in Zenniq Academy programs.
4Minor Participants and Parent/Guardian Responsibility
For all minor participants, the parent or legal guardian is fully responsible for registration, payment, attendance, transportation, punctuality, conduct, communication, medical disclosure, emergency information, compliance with academy policies, and the player’s behavior during training and tournaments.
The parent or legal guardian confirms that the minor participant is physically and medically able to participate in tennis training, sports activities, physical conditioning, and related academy activities.
Parents and legal guardians are responsible for informing Zenniq Academy in writing of any medical condition, allergy, injury, limitation, medication, behavioral concern, or special circumstance that may affect the player’s participation.
5Registration Information
All registration information provided to Zenniq Academy must be accurate, complete, and current.
Zenniq Academy is not responsible for issues caused by incorrect phone numbers, incorrect emails, outdated emergency contacts, missing medical information, incorrect player information, or failure to update registration details.
Zenniq Academy reserves the right to refuse or cancel registration if false, incomplete, or misleading information is provided.
6Payment Policy
All monthly payments, program fees, camp fees, clinic fees, private lesson fees, evaluation fees, tournament preparation fees, uniform fees, and any other academy-related charges must be paid according to the invoice, payment link, payment request, or program agreement issued by Zenniq Academy.
Monthly payments are due no later than the third (3rd) day of each month, unless Zenniq Academy approves a different arrangement in writing.
If an invoice is sent after the beginning of the month, payment must be completed within three (3) days from the date the invoice is received or sent through the academy’s payment system, email, text message, WhatsApp, or official communication channel.
A player’s spot in a program is not fully secured until payment is received, unless otherwise approved by Zenniq Academy in writing.
7Late Payments, Declined Payments, and Unpaid Balances
Failure to pay on time may result in suspension of training, removal from the program, loss of reserved spot, restriction from tournaments or academy activities, or cancellation of participation until the balance is paid in full.
Zenniq Academy is not required to hold a player’s spot if payment is not received on time.
If a payment is declined, disputed, reversed, charged back, returned, or unpaid, the responsible party must immediately resolve the outstanding balance.
Zenniq Academy reserves the right to charge reasonable administrative fees, processing fees, late fees, or collection-related costs when permitted by law and when applicable.
A player may not continue participating while there is an unpaid balance unless Zenniq Academy approves an exception in writing.
8No Refund Policy
All payments are final and non-refundable unless otherwise required by applicable law or expressly approved in writing by Zenniq Academy.
Payments made for monthly programs, camps, clinics, private lessons, evaluations, uniforms, tournament preparation, sponsored activities, or any academy-related service are not refundable due to travel, vacations, lack of attendance, personal decisions, change of mind, illness, injury, transportation problems, school conflicts, tournament conflicts, schedule conflicts, lack of interest, family plans, or any other personal reason outside the control of Zenniq Academy.
Payment secures access to the program, schedule, coaching structure, court planning, and academy resources. It does not guarantee that unused classes will be refunded, transferred, credited, or accumulated.
9Monthly Program and No Rollover Policy
Classes included in a paid monthly program must be used during the same paid month.
Unused classes do not roll over to the following month and are not cumulative.
Missed classes from one month cannot be transferred to a future month, another player, another family member, another program, a private lesson, a camp, a clinic, or any other academy service unless Zenniq Academy approves an exception in writing.
Zenniq Academy may, at its sole discretion, offer a courtesy make-up opportunity when possible. However, a courtesy make-up does not create an obligation, guarantee, credit, refund, precedent, or permanent policy.
10Attendance Policy
Players are expected to attend their scheduled training sessions consistently and on time.
Attendance is the responsibility of the player and/or the parent or legal guardian.
If a player misses class due to travel, vacation, family plans, lack of interest, personal decision, schedule conflict, transportation issue, school activity, tournament, illness, injury, failure to attend, or because the player does not want to attend, the missed class is not guaranteed to be recovered, credited, refunded, transferred, or accumulated.
Zenniq Academy plans its groups, courts, coaches, and training structure based on confirmed registrations. Missed attendance affects the player’s development but does not change the payment obligation.
11Make-Up Class Policy
Make-up classes are not guaranteed for absences caused by the player, parent, guardian, family schedule, personal plans, travel, lack of interest, transportation issues, school activities, tournaments, illness, injury, or any other reason not caused by Zenniq Academy.
If Zenniq Academy offers a make-up opportunity, the date, time, group, coach, format, and location will be determined by Zenniq Academy based on court availability, coach availability, player level, group capacity, safety, and academy scheduling needs.
If the player does not attend the make-up class offered by Zenniq Academy, the academy is not required to provide another make-up class, refund, credit, rollover, or additional replacement.
Make-up classes may not match the same coach, time, group, level, court, duration, or format of the original missed class.
Make-up classes cannot be demanded on specific days or times by the parent, guardian, or player.
12Weather, Rain, and Court Closure Policy
Outdoor tennis activities may be affected by rain, lightning, unsafe court conditions, extreme heat, cold, wind, poor visibility, school facility closures, district restrictions, court closures, maintenance issues, or other conditions beyond the control of Zenniq Academy.
Zenniq Academy reserves the right to determine whether training conditions are safe and whether a session should be delayed, modified, moved, shortened, rescheduled, or canceled.
If Zenniq Academy cancels a class due to rain, lightning, unsafe court conditions, or weather-related reasons, the academy will make reasonable efforts to offer a replacement class, make-up session, schedule adjustment, or alternative training date.
The make-up date, time, location, and format for weather-related cancellations will be determined by Zenniq Academy.
If the player does not attend the scheduled weather make-up class offered by Zenniq Academy, the academy does not guarantee an additional make-up opportunity, refund, credit, transfer, or rollover.
Weather-related make-up classes are subject to court availability, coach availability, group size, player level, safety conditions, and academy scheduling needs.
13Academy Schedule, Group, Coach, and Program Changes
Zenniq Academy reserves the right to modify training schedules, court assignments, coach assignments, group placement, training times, class duration, class format, player groups, program structure, or locations when necessary.
Changes may be made for safety, player level, training quality, court availability, weather, facility restrictions, school restrictions, academy operations, coach availability, attendance levels, or business needs.
Placement in a specific group, coach, or schedule is not guaranteed permanently.
Player placement is based on level, age, behavior, effort, maturity, attendance, technical ability, physical readiness, competitive goals, and the professional judgment of Zenniq Academy.
14Drop-Off, Pick-Up, and Supervision
Parents and guardians are responsible for safely dropping off and picking up players on time.
Zenniq Academy is responsible for organized academy activity only during the scheduled training session or program time.
Parents and guardians are responsible for the player before the session begins and immediately after the session ends.
Zenniq Academy is not a daycare, childcare center, babysitting service, or custodial care provider.
Repeated late pick-up, unsafe drop-off, lack of supervision outside scheduled training time, or failure to follow facility rules may result in disciplinary action, suspension, removal from the program, or termination of enrollment.
15Health, Hydration, and Physical Readiness
Players must arrive physically prepared for training.
Parents and players are responsible for proper hydration, nutrition, sun protection, appropriate clothing, medical readiness, and informing the academy of any relevant health condition.
Players should bring water, proper tennis equipment, and any medically necessary items approved by the parent or guardian.
Zenniq Academy coaches are not medical professionals and do not provide medical diagnosis, medical treatment, or medical advice.
If a player appears sick, injured, dehydrated, overheated, unsafe, or unable to participate, Zenniq Academy may restrict, modify, or stop participation for safety reasons.
16Safety, Injury, and Assumption of Risk
Tennis, physical conditioning, competitive training, tournaments, camps, clinics, and sports activities involve inherent risks.
These risks may include, but are not limited to, falls, collisions, muscle strains, sprains, heat-related illness, dehydration, overuse injuries, impact injuries, equipment-related injuries, accidents, court-related injuries, contact with other players, and other physical risks.
By participating in Zenniq Academy activities, the player and/or parent or legal guardian voluntarily accepts these risks.
To the fullest extent permitted by law, the player, parent, legal guardian, or responsible party releases Zenniq Academy, its owners, coaches, staff, contractors, representatives, partners, affiliates, sponsors, facilities, and related parties from claims, damages, expenses, losses, injuries, or liabilities arising from participation in academy activities, except where liability cannot be excluded under applicable law.
17Medical Emergencies
In the event of an emergency, Zenniq Academy may contact the parent, legal guardian, emergency contact, school personnel, facility personnel, emergency medical services, or other appropriate responders.
If the parent or legal guardian cannot be reached immediately, the parent or legal guardian authorizes Zenniq Academy to take reasonable action in the best interest of the player.
The parent or legal guardian is responsible for all medical expenses, emergency costs, transportation costs, treatment costs, or related expenses.
Zenniq Academy is not responsible for delays, decisions, costs, or outcomes related to emergency medical care provided by third parties.
18Equipment and Personal Belongings
Players are responsible for bringing their own racquet, water, proper tennis shoes, tennis clothing, and any required training equipment unless otherwise instructed by Zenniq Academy.
Zenniq Academy is not responsible for lost, stolen, damaged, or misplaced personal items, including racquets, bags, phones, clothing, shoes, watches, jewelry, electronics, water bottles, or other belongings.
Players should not bring unnecessary valuables to training or academy activities.
19Uniform and Dress Code Policy
Proper tennis attire is required for all training sessions, academy activities, and tournament participation when representing Zenniq Academy.
Players must wear appropriate tennis shoes designed for court use. Running shoes, casual shoes, sandals, Crocs, boots, open-toe shoes, or unsafe footwear are not allowed during training.
Players must wear proper tennis clothing, including athletic shirts, tennis shirts, shorts, skirts, or tennis-appropriate apparel.
Shorts must be black or navy blue unless otherwise approved by Zenniq Academy.
The official Zenniq Academy uniform is mandatory when required by the academy, including but not limited to tournaments, official events, academy representation, photos, videos, showcases, sponsored participation, or team activities.
When Zenniq Academy provides, sponsors, discounts, assigns, or requires uniforms, players must use the uniform according to academy instructions.
Failure to comply with uniform requirements may affect participation in training, tournaments, events, team activities, academy representation, sponsorship benefits, or academy privileges.
20Tournament Representation and Sponsored Uniform Policy
Players representing Zenniq Academy in tournaments, events, showcases, photos, videos, or public activities must maintain professional behavior, discipline, sportsmanship, respect, and a positive attitude at all times.
When participating in tournaments as part of the academy’s image, sponsorship, development structure, or competitive program, players are required to wear the official Zenniq Academy uniform.
The uniform represents the academy brand, sponsorship, team identity, and professional image. Use of the academy uniform during tournaments and academy representation is mandatory when instructed by Zenniq Academy.
Failure to wear the required academy uniform during tournaments or official academy activities may result in loss of tournament representation privileges, loss of sponsorship benefits, restriction from academy events, disciplinary action, suspension, or removal from the academy.
21Player Code of Conduct
All players must behave with respect, discipline, effort, responsibility, and a positive attitude during training, tournaments, academy events, and any activity connected to Zenniq Academy.
Players must respect coaches, teammates, opponents, parents, tournament officials, facility staff, and other families.
- Bullying, harassment, intimidation, or discrimination is prohibited.
- Profanity, offensive language, insults, yelling, or disrespect is prohibited.
- Bad attitude, repeated negativity, or disruptive behavior is prohibited.
- Aggressive behavior toward players, coaches, parents, officials, opponents, or staff is prohibited.
- Throwing racquets, balls, equipment, or personal items in an unsafe manner is prohibited.
- Refusing to follow coach instructions is prohibited.
- Interrupting training or distracting other players is prohibited.
- Cheating, poor sportsmanship, or disrespectful tournament conduct is prohibited.
- Damaging academy property, facility property, school property, court equipment, or another person’s property is prohibited.
- Any behavior that affects the safety, learning environment, reputation, or operation of Zenniq Academy is prohibited.
Zenniq Academy may take disciplinary action when necessary, including verbal warning, parent meeting, written warning, temporary suspension, removal from a group, loss of tournament representation privileges, or termination from the academy without refund.
22Anti-Bullying, Harassment, and Respect Policy
Zenniq Academy does not tolerate bullying, harassment, intimidation, discrimination, humiliation, threats, verbal abuse, physical aggression, cyberbullying, or disrespectful behavior.
This policy applies during training, tournaments, camps, clinics, academy events, group communications, online communications, social media interactions, and any activity connected to Zenniq Academy.
Any player, parent, guardian, family member, or guest who engages in bullying, harassment, disrespect, aggressive conduct, or harmful behavior may face disciplinary action, including suspension or removal from the academy.
Zenniq Academy reserves the right to act immediately when conduct affects safety, team culture, player development, academy reputation, or the professional training environment.
23Parent and Guardian Code of Conduct
Parents and guardians are expected to support the player, respect the coaches, respect other families, and allow the training process to operate professionally.
Parents and guardians must communicate respectfully with coaches, players, staff, tournament officials, facility staff, and other families.
- Disrespectful language toward coaches, players, parents, officials, or staff is prohibited.
- Threats, harassment, intimidation, or aggressive behavior is prohibited.
- Public confrontations or arguments during training or tournaments are prohibited.
- Defamation, false statements, or actions that damage the reputation of Zenniq Academy are prohibited.
- Interference with coaching decisions, player placement, training structure, or group organization is prohibited.
- Creating conflict with other families, players, coaches, or facilities is prohibited.
- Pressuring or distracting players during training or competition is prohibited.
Zenniq Academy reserves the right to restrict attendance, pause communication, suspend participation, remove a player from a group, or terminate enrollment if parent or guardian conduct negatively affects the academy, players, coaches, families, facilities, reputation, or operations.
24Parent and Guardian Non-Interference Policy
Parents, guardians, family members, or guests may not interfere with training sessions, coaching instructions, player corrections, group organization, match play, physical conditioning, or academy activities.
During training, parents and guardians must allow coaches to communicate directly with the players.
Parents may not coach from outside the court, give technical or tactical instructions, correct the player during practice, interrupt the coach, call the player away from training, argue about training decisions, distract the player, or interfere while the session is in progress.
During tournaments, parents and guardians must respect all tournament rules, coaching rules, officials, opponents, other families, and academy representatives.
Parents may not interfere with matches, give unauthorized coaching, argue with officials, pressure players, create conflict with opponents or families, confront coaches during competition, or behave in a way that affects the player’s performance, the tournament environment, or the reputation of Zenniq Academy.
Zenniq Academy reserves the right to restrict a parent’s or guardian’s presence at training, suspend a player from participation, remove a player from a group, limit tournament representation, or terminate enrollment if parent or guardian behavior interferes with the academy’s training process, player development, tournament conduct, coaching authority, safety standards, or professional environment.
All communication with coaches must be handled respectfully and at appropriate times, preferably before or after training or through the official communication channels established by Zenniq Academy.
25Tournament Conduct
Players and parents must follow all tournament rules, facility rules, USTA rules when applicable, official instructions, sportsmanship standards, and academy expectations.
Poor behavior during tournaments may affect the player’s standing within Zenniq Academy.
Tournament misconduct may include, but is not limited to, arguing with officials, disrespecting opponents, cheating, code violations, racquet throwing, profanity, aggressive behavior, bullying, public disrespect, refusing to compete properly, or damaging the reputation of Zenniq Academy.
Zenniq Academy may take disciplinary action for tournament misconduct, even if the tournament is not directly organized by Zenniq Academy, when the player is representing the academy, wearing the academy uniform, receiving academy coaching, or publicly associated with the academy.
26Communication Policy
Zenniq Academy may communicate with parents, guardians, adult participants, or responsible parties through email, phone, SMS, WhatsApp, payment platforms, website forms, social media, or other official communication channels.
Parents and guardians are responsible for checking academy communications, schedule updates, payment reminders, weather updates, and program announcements.
Zenniq Academy is not responsible for missed communications due to incorrect contact information, blocked messages, unread emails, spam folders, phone issues, messaging app issues, or failure to check official academy communications.
All communication with Zenniq Academy must remain respectful, professional, and appropriate.
27Communications and Text Messages
By providing a phone number, email address, or submitting a registration form, the user authorizes Zenniq Academy to contact them by phone call, text message, email, WhatsApp, or other communication channels for administrative, informational, scheduling, payment, reminder, program, emergency, or service-related purposes.
Message and data rates may apply.
The user may unsubscribe from SMS messages at any time by replying STOP, when applicable.
Zenniq Academy may still need to communicate important service-related, safety-related, payment-related, or program-related information through other available channels.
Promotional or marketing text messages may require separate consent when required by applicable law.
28Media, Photo, and Video Release
Zenniq Academy may take, record, publish, and use photos, videos, audio, player images, training footage, tournament footage, group activities, testimonials, performance clips, and academy-related media during training sessions, tournaments, camps, clinics, events, evaluations, and any academy-related activity.
By registering for or participating in any Zenniq Academy program, the player, parent, or legal guardian authorizes Zenniq Academy to use the player’s name, image, likeness, voice, photo, video, performance footage, and academy-related media for educational, promotional, marketing, social media, website, advertising, internal review, player development, documentation, and academy branding purposes.
This authorization includes, but is not limited to, use on the Zenniq Academy website, social media platforms, digital advertisements, printed materials, flyers, brochures, presentations, newsletters, email campaigns, training videos, promotional reels, and other academy communication channels.
The parent or legal guardian understands that photos and videos may be visible to the public when published on social media, websites, advertisements, or promotional materials.
To the fullest extent permitted by law, the parent, legal guardian, or adult participant grants Zenniq Academy a non-exclusive, royalty-free, worldwide license to use academy-related photos, videos, images, likeness, voice, and media content without compensation.
Zenniq Academy will use media professionally and in alignment with the academy’s brand, safety standards, and promotional purposes.
Zenniq Academy will not intentionally use images or videos in a defamatory, inappropriate, or harmful manner.
If a parent or legal guardian does not authorize the use of the player’s image, they must submit a written request to Zenniq Academy before the player participates in any activity.
Zenniq Academy will make reasonable efforts to honor written media restrictions after receiving them. However, Zenniq Academy cannot guarantee removal from group photos, background footage, live event recordings, tournament media, public event footage, third-party content, or content already published before the written request was received.
29Privacy and Children’s Information
Zenniq Academy may collect personal information through registration forms, payment forms, communication forms, waivers, academy records, attendance records, emergency contact forms, media, and program participation.
Information may include player name, parent or guardian name, contact information, date of birth, age, tennis level, medical notes voluntarily provided by the parent or guardian, emergency contacts, payment status, attendance records, photos, videos, and other information necessary to operate academy programs.
Zenniq Academy uses this information for registration, program operation, scheduling, safety, communication, payment administration, emergency response, player development, marketing, and academy management.
For minor participants, the parent or legal guardian authorizes Zenniq Academy to collect and use the information necessary to provide academy services.
Additional privacy practices may be described in Zenniq Academy’s Privacy Policy. If there is any conflict between the Privacy Policy and these Terms regarding academy operations, Zenniq Academy reserves the right to interpret both documents in a manner consistent with applicable law and academy safety requirements.
30Intellectual Property
All content available on this website and through Zenniq Academy programs, including logos, names, text, images, graphics, videos, training methods, lesson structures, programs, documents, digital materials, systems, forms, and academy materials, is the property of Zenniq Academy or its licensors and is protected by applicable intellectual property laws.
Reproduction, copying, distribution, resale, public use, modification, or unauthorized use of any academy content, training systems, images, videos, documents, methods, or intellectual property is prohibited without prior written authorization.
Players, parents, guardians, or third parties may not copy, record, distribute, commercialize, or publicly share academy training methods, private coaching content, internal materials, or proprietary program information without written permission.
31Website Use
The user agrees to use the Zenniq Academy website, forms, payment links, communication channels, and digital services only for lawful and appropriate purposes.
Misuse of content, unauthorized access, false information, alteration of registration details, interference with systems, abuse of forms, fraudulent payments, or any conduct that may affect the operation, security, reputation, coaches, students, families, or business interests of Zenniq Academy is strictly prohibited.
Zenniq Academy reserves the right to restrict access to its website, forms, programs, or communication channels if misuse is suspected.
32Third-Party Platforms and Services
Zenniq Academy may use third-party platforms for payments, forms, scheduling, communications, email, SMS, website hosting, media, marketing, or business operations.
Zenniq Academy is not responsible for failures, delays, processing issues, privacy practices, outages, fees, or errors caused by third-party platforms.
Users are responsible for reviewing and complying with any applicable third-party terms when using payment processors, communication tools, social media platforms, or external services connected to academy operations.
33Facility Rules and Property Damage
Zenniq Academy may operate at schools, tennis courts, parks, clubs, rented locations, or third-party facilities.
Players, parents, guardians, guests, and family members must respect all facility rules, school rules, district rules, court rules, parking rules, safety instructions, and property restrictions.
Any damage caused by a player, parent, guardian, guest, or family member may be the financial responsibility of that person or family.
Zenniq Academy reserves the right to remove any player or family from participation if facility rules are violated.
34Right to Refuse, Suspend, or Terminate Service
Zenniq Academy reserves the right to refuse service, suspend participation, terminate enrollment, remove a player from a program, restrict attendance, limit tournament representation, or deny future registration if Zenniq Academy determines that continued participation is not in the best interest of the player, group, coaches, academy, facility, or other families.
Reasons may include, but are not limited to, non-payment, repeated absences, misconduct, bullying, disrespect, unsafe behavior, violation of policies, parent interference, reputational harm, facility rule violations, failure to wear required uniform, tournament misconduct, or failure to comply with academy standards.
Termination due to policy violations does not guarantee any refund, credit, transfer, or reimbursement of paid fees.
35Disciplinary Measures
Zenniq Academy may apply disciplinary measures when necessary to protect safety, order, professionalism, player development, team culture, and academy reputation.
- Verbal warning.
- Written warning.
- Parent or guardian meeting.
- Temporary removal from class.
- Temporary suspension.
- Change of group.
- Loss of tournament representation privileges.
- Loss of sponsorship or uniform benefits.
- Restriction from events.
- Termination from the academy.
- Denial of future registration.
Zenniq Academy has discretion to determine the appropriate disciplinary measure based on the seriousness, frequency, and impact of the conduct.
36No Guarantee of Results
Zenniq Academy provides professional tennis training, player development, coaching, structure, and guidance.
However, results are not guaranteed.
Zenniq Academy does not guarantee rankings, scholarships, tournament victories, UTR improvement, USTA ranking improvement, college placement, professional opportunities, school team selection, academy team selection, or any specific athletic achievement.
Progress depends on the player’s effort, consistency, discipline, attitude, attendance, training frequency, competition schedule, physical development, emotional maturity, family support, and other external factors.
37Limitation of Liability
To the fullest extent permitted by law, Zenniq Academy, its owners, coaches, staff, contractors, representatives, partners, affiliates, sponsors, facilities, and related parties shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to participation in academy programs, use of the website, training activities, tournaments, communications, scheduling, cancellations, injuries, lost items, weather closures, facility closures, or academy services.
Zenniq Academy is not responsible for injuries, accidents, personal damages, losses, medical expenses, property damage, missed tournaments, missed opportunities, emotional distress, loss of ranking, loss of performance, or other claims arising from participation, except where liability cannot be excluded under applicable law.
38Indemnification
To the fullest extent permitted by law, the player, parent, legal guardian, or responsible party agrees to indemnify, defend, and hold harmless Zenniq Academy, its owners, coaches, staff, contractors, representatives, partners, affiliates, sponsors, facilities, and related parties from any claims, demands, damages, losses, expenses, liabilities, attorney’s fees, or costs arising from:
- The player’s participation in academy activities.
- Violation of these Terms.
- Non-payment or disputed payments.
- Player misconduct.
- Parent or guardian misconduct.
- Facility rule violations.
- Property damage.
- Injury claims.
- Unauthorized use of academy content.
- False or incomplete registration information.
- Any act or omission by the player, parent, guardian, guest, or family member.
39Force Majeure
Zenniq Academy is not responsible for delays, cancellations, modifications, or inability to provide services caused by events beyond its reasonable control.
Such events may include, but are not limited to, weather, rain, lightning, extreme heat, natural disasters, facility closures, school closures, government restrictions, public health emergencies, power outages, court maintenance, unsafe conditions, labor shortages, coach emergencies, transportation disruptions, acts of God, or other circumstances beyond the academy’s control.
Zenniq Academy may modify, reschedule, delay, shorten, relocate, or cancel services when necessary due to such events.
40No Verbal Modification of Policies
Zenniq Academy’s written Terms of Service, invoices, registration forms, waivers, payment agreements, and official written communications control the relationship between the academy and the player, parent, legal guardian, or responsible party.
Verbal conversations, informal comments, text messages, or explanations provided by coaches or staff do not modify, cancel, waive, or replace these Terms of Service unless Zenniq Academy confirms the change in writing.
Any exception, courtesy make-up, payment arrangement, discount, schedule adjustment, or special accommodation must be approved in writing by Zenniq Academy.
A one-time exception, courtesy make-up, courtesy extension, discount, payment arrangement, or special accommodation does not create a permanent right, guarantee, obligation, precedent, or modification of these Terms.
41Policy Exceptions
Any exception to these Terms must be approved in writing by Zenniq Academy.

Zenniq Academy reserves the right to apply policies consistently while also making discretionary decisions when appropriate.

Zenniq Academy reserves the right to modify, update, expand, or replace these Terms of Service at any time.
Updated terms will be effective once posted on the website or communicated through official academy channels.
Continued use of the website, forms, programs, training, or services after updates are posted means that the user accepts the revised Terms of Service.
43Governing Law
These Terms of Service shall be interpreted according to the laws of the State of Texas, unless another law is required to apply.
To the extent permitted by law, any dispute related to Zenniq Academy, its services, these Terms, payments, participation, or academy activities shall be handled in the appropriate jurisdiction where Zenniq Academy operates.
44Severability
If any provision of these Terms is found to be invalid, unenforceable, or prohibited by law, the remaining provisions shall continue in full force and effect.
The invalid or unenforceable provision shall be interpreted as closely as possible to the original intent while complying with applicable law.
45Entire Agreement
These Terms of Service, together with any registration forms, waivers, payment agreements, invoices, privacy policies, written academy rules, or program-specific policies, represent the agreement between Zenniq Academy and the player, parent, legal guardian, or responsible party.
These Terms replace any prior verbal or informal understanding related to academy policies unless otherwise confirmed in writing by Zenniq Academy.
